Jenni Hermoso asks the judge to suspend future statements if necessary to avoid leaks

The player of the Spanish team Jenni Hermoso has presented before the judge of the National Court investigating the 'Rubiales case' a document in which she raises the possibility of suspending the next statements planned in the case if necessary to avoid this forms new leaks.

Legal sources have confirmed to Europa Press that the soccer player's legal team has asked the head of the Central Court of Instruction Number 1, Francisco de Jorge, in a letter that measures be taken to avoid new leaks and parallel trials, requesting that responsibilities be resolved. and, if necessary, the next summons would be paralyzed, warning the different parties that are part of the procedure.

Hermoso's representation refers to the possibility of suspending all statements and not just his, which still has no date, to try to safeguard judicial secrecy.. In addition, it requests that the leaks of recent weeks be brought to the attention of the Data Protection Agency.

The judge will hear the director of the National Team, Albert Luque, as investigated on October 16. Already in November, on the 2nd he will take a statement from the men's coach, Luis de la Fuente, the former director of Communication of the RFEF Pablo García Cuervo and the deputy director of Communication, Enrique Yunta.

Finally, on November 14, the judge summoned the psychologist of the women's team, Javier López Vallejo, the former director of Rubiales' Cabinet, José María Timón, and the person in charge of compliance for the team, Javier Pujol.

For his part, the main investigator in the case, Luis Rubiales, has urged the magistrate to try to put an end to the leaks and to respect procedural secrecy.

On the other hand, the legal team of the Spanish national team soccer player Jenni Hermoso announced this Wednesday that it will undertake different actions with the aim of protecting and guaranteeing the privacy of its client after the video of the declaration of the player before the Prosecutor's Office on September 5, when she formalized the complaint against the former president for the kiss he gave her at the World Cup trophy presentation held in Sydney (Australia).

In a press release issued by its representation agency, TMJ, collected by Europa Press, it is noted that the purpose is to redirect the open criminal procedure that is being followed in the National Court after this leak to the media – the images were broadcast on Monday passed by Telecinco.

“We want to remember that all criminal proceedings must be carried out with guarantees to preserve the right to privacy of the victims,” they indicate, and point out that although until a few days ago they thought that this process offered Jenni (Hermoso) a safe environment, “the “continuous leaks and the lack of said guarantees prevent the player from being able to carry out the process normally.”

For TMJ “the limits have been exceeded, (…) the basic rights of Jenni (Hermoso) have been violated and she has been exposed to public opinion again without any type of consent, violating her data protection rights.”

In this sense, they explain that the events not only put their health at risk, but “also put at risk the reliability and independence of the judicial process” which is why they urge the competent bodies to take measures against those responsible for the leaks and to search for solutions to guarantee the security and custody of case information during the criminal process.

Restricted access

It should be remembered that the judge investigating the matter at the National Court, Francisco de Jorge, already reacted to the leak of the audio of Rubiales' own statement by restricting access to the audios.

Legal sources confirmed to Europa Press on October 5 that De Jorge agreed that only the transcripts of the statements would be provided to the parties in person and not the audio of them.
