Outrage in the CGPJ with Mozo and the Government for not being able to assess the salary increase of judges in time

SPAIN

Members of the General Council of the Judiciary (CGPJ) will request President Rafael Mozo to call off the extraordinary plenary session set for next Wednesday where the salary increase agreed with the Government for judges will be assessed. In addition, they describe as “unusual” having been “excluded” from the signing of the agreement that will take place this Tuesday at 1:00 p.m. at the Ministry of Justice.

The councilors Enrique Lucas, José María Macías, Carmen Llombart, José Antonio Ballestero and Gerardo Martínez Tristán asked Mozo last Friday to convene that extraordinary plenary session for this Monday but the president set it this Monday to be held on Wednesday.

However, the Ministry of Justice has summoned the representatives of the judicial and prosecutorial associations for Tuesday – the representatives of the Council who have attended punctually the meetings of the remuneration table have not been summoned – to sign the pact with the improvement of the remuneration of the togados.

Hence, according to legal sources reported to EL MUNDO, the members are going to ask the president to annul the extraordinary plenary session set today and to return to the convening of the ordinary plenary session on Thursday for the Council, then including the proposal on the adaptation of judges' remuneration.

On the other hand, legal sources describe as “unworthy” that the Ministry has not summoned its representatives to tomorrow's meeting. “This is an unusual institutional situation”, they add.

The CGPJ have only received an email where “it is recalled that, as was said at the last meeting of the commission for the salary adequacy of the judicial and fiscal careers, the agreement reached with the associations will be ratified on Tuesday, May 23, 2023 at 1:00 p.m. at the headquarters of the Ministry of Justice”.

Finally, legal sources maintain that in the event that this call had been carried out effectively “attendance would not be possible either because the Plenary has not been able to ratify any proposal because its president (by substitution) has not summoned him to his due time”.
