The Colmenar judge withdraws the restraining order for the father arrested for mistreating his eight children

The court number 1 of Colmenar Viejo has decided today to withdraw the restraining order of his wife for the father arrested for allegedly mistreating his eight children. The magistrate has adopted this decision, despite the opposition of the Public Prosecutor's Office.

The alleged victim recently denied that she was mistreated and asked to return to her husband, an emergency doctor at the Gregorio Marañón Hospital.. According to the judicial decision, the woman had “stated that she wanted the precautionary protection measures to be annulled, a request that she externalized to do it freely and voluntarily.”. At the moment, the father and mother of the children are still accused of mistreating their eight children

Last March, the magistrate adopted the precautionary measure of estrangement from his wife for the detained doctor following the proposal of the Prosecutor's Office, after accusing him of a crime of domestic violence after indicating the older children that their father mistreated their mother. The woman did not want to denounce the Gregorio Marañón doctor before the Civil Guard.

In a document sent on April 18 to the Colmenar Viejo Court, the woman requested the cessation of the precautionary measure and the filing and dismissal of the present case.. The doctor's wife indicated that there were no indications of criminality and no lack of objective risk. Therefore, he asks that the protection order be revoked.. The woman indicated that she did not want to denounce her husband because “she had never been physically, psychologically or financially mistreated.”

The magistrate of Colmenar Viejo indicates in the order that the allegedly mistreated woman has not had her will annulled by her husband and that “certainly the existence of an objective and present risk for the woman is not apparent either, contrary to what could be said to cease the protection of minors vis-à-vis their parents”.

Likewise, the judge stresses that the mother of the allegedly mistreated children has denied any act “of violence against her and against her children, attributing the weight of responsibility for the present investigation to their fabrication, their already reiterated firm and unhesitating statement in court, exposing, in turn, without fissures her desire for the order to cease in front of her”.

On March 29, the Civil Guard arrested this 56-year-old emergency doctor from the Gregorio Marañón Hospital in Madrid at his home in Colmenar Viejo, and his 45-year-old wife, accused of mistreating their eight minor children.. The children were allegedly “physically punished, they were malnourished and slept cornered on several bunk beds in a room” of the “totally unsanitary” house.. The minors, from four to 14 years old, told the agents that they were assaulted, that they missed class and that they received degrading treatment from their father.. The parents were released after testifying and lost guardianship of the eight children with whom they lived. All the siblings are now together in a shelter in the Community of Madrid.

Two of the older daughters have confirmed in court that they were assaulted by their father and have exculpated their mother of the abuse. They have asked to return to their parent and have said that the father forced them to watch porn and play some scene.
