The Supreme Court sentences a man who distributed videos of children to 135 years in prison for child pornography

The Supreme Court (TS) has sentenced to 135 years in prison a man who distributed photos and videos on pedophilia forums of around thirty children whom he cared for at home or taught English at a school in Madrid.

The magistrates have ratified the sentence imposed on the British citizen for eight crimes of making child pornography with the aggravating circumstance of recidivism, 32 crimes of discovery of disclosure of secrets and 1 crime against moral integrity.

In the sentence, it is stated that the man – who had been convicted of a crime of child pornography in England in 2016 – began his criminal activity in Spain in August of that same year; specifically, in Zaragoza, where he was hired by a family as an 'au pair' and caretaker for two girls and a boy.

According to the resolution, the accused took photographs and videos of the two naked sisters and distributed them to third parties.. He did the same with three other minors that he cared for in Madrid during 2017.

“DEGRADING AND HUMILIANT” FACTS

On these facts, the court has stressed that it was “objectively degrading and humiliating behavior and with sufficient entity to undermine the moral integrity of the victim turned into a pure instrument of humiliation and objectification.”

In line, the magistrates have insisted that the fact that “the minor did not suffer harm for not being aware of what was happening, does not diminish the vileness or degradation of the action undertaken.”

A year later, between January 2018 and June 2019, the man worked at a school in Madrid, where, “taking advantage of his status as a teacher, and taking advantage of the fact that he was alone in class with the minors, he recorded several videos and took photographs to the minors focusing on the panties and on other occasions, putting the camera under the skirt”.

In addition, the court has considered it accredited that the defendant made part of said child pornography material available to third parties and various montages that he composed by distributing them on a pedophilia forum.

Thus, the Supreme Court has stressed that the man, “in addition to not having the authorization of all the parents to record their daughters, never had her, neither to record their underwear, nor to take pictures of the minors showing their underwear and even less to use the zoom and to focus the camera under their skirts”.

“Nor was he authorized to transfer these images later to third parties, as he did. All these actions suppose, without any doubt, an impairment of the dignity and privacy of the minors”, added the magistrates.

COPY OF A FAKE PASSPORT

The sentence states that the man, in order to hide his criminal record and be able to work as a native English assistant teacher in two centers, provided a copy of an Israeli passport that turned out to be a false reproduction.

In turn, he presented copies of an official degree from a University of Hertfordshire and a certified teaching certificate that also turned out to be false reproductions.

In 41 pages, the Supreme Court has dismissed the defendant's appeal, except in relation to the 1-year and 9-month sentence that was imposed on him for the continued crime of falsifying official documentation, considering that since they are copies it could be a crime false private document but not official documentation.
