The Criminal Court number 27 of Madrid has indicated for the next September 25 the start of the trial of the actor and producer of porn films Ignacio Allende, Torbe, accused of distribution and possession of child pornography, after the parties have not arrived to an agreement on penalties.
The magistrate has set this date after having brought together the parties to the case up to two times, the first on July 10, when the trial was scheduled to begin, and the second on Tuesday.
The objective was to assess a possible agreement between the three defendants and the Prosecutor's Office, or reformulate the script of the future trial, to expedite it.
After not reaching an agreement, the magistrate has finally indicated the start of the trial for September 25, 2023, sources from the Superior Court of Justice (TSJM) have confirmed to EFE.
These sources have specified that a first session is set for that day with the previous issues, and the development of the trial will be determined at that time..
On the other hand, legal sources have detailed to EFE that it is possible that Torbe and one of the other two defendants, Francisco José ML, do reach an agreement with the Prosecutor's Office, so that they would acknowledge the facts to see their sentences reduced, although this is yet to be confirmed.
In its provisional conclusions, the Prosecutor's Office requests seven years and seven months in prison for the porn film producer for allegedly distributing child pornography of two minors whom he recorded.
It also requests three years in prison for José Carlos PR, accused of distribution of child pornography, and also requested one year for Francisco José ML, for possession, although in this last session it has reduced the penalty request to a fine.
For its part, the popular accusation, exercised by the lawyer Manuel Merino on behalf of the National Association of People Affected by the Internet and New Technologies (Anfitec), requests eight years in prison for Torbe and two years for Francisco José ML.
The facts date back to October 21, 2015, when, according to the Prosecutor's Office, Torbe received a message from a young woman who, after stating that she was of legal age, offered to make videos because she wanted to be a porn actress and even recorded one, although he did not want his face to be seen.
Torbe and the young woman met again to record more sex scenes with another woman and the producer, a follower of Athletic Bilbao, asked the girl to put on the team's shirt and while exclaiming “Aúpa Athletic” to show her chest .
A month later, the young woman phoned Torbe to warn him that said video, sent without his consent, had gone viral and that he had not yet turned 18, and the producer removed the images from his website..
But Torbe sent photos and videos to Francisco José ML without his consent, who stored them on his computer, always according to the account in the indictment of the Prosecutor's Office.
