They close the case against the police officer accused of touching the chest of a Femen activist because "lubricious or sexual purpose" was not appreciated
A Madrid judge has closed the case against the national police officer investigated for grabbing a Femen activist by the breasts in a protest, understanding that the photographs of the events reveal that “the contact with the breasts was not the only physical contact between the agent and plaintiff”, who put up “active resistance”.
In a car to which Efe has had access, the Madrid Investigating Judge number 1 points out that “the fact of carrying out the protest naked from the waist up implied the possibility that, in its foreseeable reduction by force, some contact might take place physical with his bare chest, especially if there was active resistance”.
But the judge stresses that it cannot be concluded that the national police officer, a component of the Police Intervention Unit (UIP), touched her “for lewd or sexual purposes,” as the activist argued in her complaint.
The events date from last November 20, when three members of Femen went to the Plaza de Oriente in Madrid to protest against a rally organized by the Spanish Catholic Movement.
Several riot police officers came out in their path and proceeded to reduce them, a performance that was captured by a photojournalist whose images were contributed to the cause.
The defendant agent, defended by the legal services of the Jupol union, declared before the judge that he did not touch the activist's breasts but used a “police technique” to reduce her from behind while holding her by the shoulders.
The general secretary of Jupol, Aarón Rivero, has declared to Efe that he is “very satisfied” with the filing of the case, since he considers it “surreal and ridiculous that a national police officer had to go through this situation due to a false and tortuous complaint who tried to charge an agent who was carrying out his work with absolute professionalism for a crime against sexual freedom”.
